Two O.D. Heck employees arrested for manslaughter

It was supposed to be a trip to the mall, but Jonathan Carey, 13, would never get there. Police said the severely autistic boy suffocated after an aide from the O.D. Heck Developmental Center restrained him.

"It was very evident that what led to the death was not a legitimate manuever or legitimate hold with their training," said Colonie Police Chief Steven Heider.

Edwin Tirado, 35, and Nadeem Mall, 32, both of Schenectady, are charged with second degree manslaughter.

Heider said they were taking Carey and another boy on a day trip to Crossgates Mall when they stopped at Hannaford so Mall could go to the ATM.

"It was between there and a Hess Mart farther up Central Avenue when the injuries took place, and the young male stopped breathing," said Heider.

Tirado and Mall then went shopping at Mohawk Commons, where police said Tirado bought a videogame. The two then drove to Schenectady to drop the game off at Tirado's home, and all this occurred while Carey was in the back of the van. Heider said Tirado and Mall waited an hour-and-a-half before calling for help.

Steven Heider "There is a potential that this person could have been saved. The two could have sought some help or provided some assistance," said Heider.

Carey was pronounced dead at St. Claire's Hospital. This isn't the first abuse experience that Carey and his family had to deal with. In 2004, their son was allegedly abused at a Dutchess County facility. So, the family along with downstate Assemblyman Harvey Weisenberg, have been fighting to change the law that would unseal Jonathan's records and find out what happened.
