Background Check Missed Previous Carroll Arrests In KY

It appears the Carrolls' background wasn't as clean as the foster agency, Lifeway For Youth, first thought.

David Carroll had been arrested in 1997 in northern Kentucky.

In 2004, Liz Carroll had been arrested on a theft charge.

The state of Ohio did conduct a background check through its criminal identification bureau, and it's true, the Carrolls' records were clean.

But the only problem is that it doesn't appear Lifeway checked the court records across the river in Kentucky.

The glowing reports from the Ohio Attorney General's Bureau of Criminal Identification and Investigation states neither of the Carrolls were ever arrested for a crime.

But a check of court records in Boone County reveals David Carroll did have a prior criminal record.

In 1997 he was arrested at the old Lazarus store in Florence.

A court clerk says the shoplifting conviction was never expunged, so it remains a part of the public record.

In Ohio, Milford police did confirm that Liz Carroll was arrested in 2004 and charged with stealing from her employer, a Target store.

When logging on to the internet to see if a national criminal background company would be able to find the conviction, the check came back clean for David Carroll.

Some local attorneys say they're not surprised.

Attorney Yvette Simpson with Keating, Muething and Klekamp logged onto the internet to see if she could dig up anything on the couple accused of murdering 3-year-old Marcus Fiesel.

"I was able to check Kentucky courts and no records came up in Boone County," Simpson said.

The state of Ohio explains David Carroll's arrest went unnoticed by the state because by law when asked to conduct a background check the search is only state-wide.

9News checked to see why Liz Carroll's conviction didn't show up.

A court clerk in Clermont County said she couldn't find it.

It's possible since the arrest occurred in Milford, it was never sent over to the county to be recorded.
