First Degree Murder Charge

Michelle Bott Graham was rearrested Tuesday afternoon for allegedly killing Cameron Hamilton.

She's now charged with murder, after the results of Hamilton's autopsy revealed his death couldn't have been caused by anything but blunt trauma to the head.

This charge comes more than two months after Hamilton's December 6th death because his autopsy results were not ready until the first of January. Prosecuting Attorney Mark Hiedeman spent a few more weeks looking over this report making sure it's strong enough to prosecute Bott Gram with 1st degree murder.

From the Bannock County Jail, a weeping Bott Graham appeared at her 2pm arraignment through a monitor. Charged with first degree murder, she faces a maximum penalty of death of life in prison.

Even though this crime might not have been premeditated, Hiedeman says this most serious of all possible charges is appropriate. "If a person commits an aggravated battery on a kid under 12 and the child dies from those injuries thats first degree murder thats first degree murder regardless of theres premeditation or not," says Hiedeman.

This story starts in November when Hamilton's mother gave Bott Graham permission to take her son away from a Chubbuck Day Care for treatment. When she returned him, Hamilton was convulsing. At first, no one knew how serious his injuries really were. "They thought that the swelling that they would be a to take care of that and that he wouldn't die, but it got to be too much and they couldn't save him," said Hiedeman.

According to Hiedeman Hamilton's autopsy results point the blame at Bott Graham. "I wanted to make sure that these injuries were caused by another human being and I was convinced of that after receiving the autopsy and talking with the pathologist," says Hiedeman.

Bott Graham's preliminary hearing is set for March 7th. She'll likely remain in the Bannock county jail until that time. Her Bond is set at a quarter of a million dollars.
