Heated exchange between both sides
at Tirado manslaughter trial

ALBANY -- There was a heated
exchange between both sides in the Edwin Tirado manslaughter trial
in Albany. Tirado is charged in the death of a 13 year old boy with
autism. The tension outside of court Friday was between Edwin
Tirado's lawyer Brian Donohue and the victim's father Michael Carey.
Testimony during day 5 of the trial was filled with accusations.
Edwin Tirado's attorney called prosecution witness Nadeem Mall a
liar regarding his testimony on Thursday. Mall was the person
driving the van the day that Jonathan Carey was restrained and later
died. Carey's father claims the attorney is lying.
"If you didn't say it on that
occasion, it means you made it up later to make your story sound
good," said Brian Donohue commenting on the testimony of Nadeem
Mall. Standing next to him Michael Carey interrupted saying "that's
not true, that's not true at all," he said.
"I'm not here to debate Mr. Carey,"
replied Donohue.
"Nadeem Mall told the police that
he covered for Edwin Tirado and what Mr. Donohue is doing is lying
radically," said Carey. He has fabricated numerous stories. He
should be embarrassed at himself and ashamed of himself. What he is
doing is disgusting, "he said.
Michael Carey is reacting to the
cross examination of Nadeem Mall in court Friday. On Thursday, Mall
testified he heard Tirado say "I think I killed him, "referring to
Jonathan Carey.
During cross examination Mall
admitted that he lied to police during his initial interview and
never told anyone else what he allegedly heard Tirado say.
Tirado's attorney poked holes at
Mall's character. Brian Donohue says Mall took a plea deal because
he says he was responsible for the night Carey died. Donohue also
pointed out that Mall was fired from a job at the Center for
Disability Services prior to working for O.D. Heck.
Michael Carey, Jonathan's father
says Edwin Tirado is the one on trial and not Nadeem Mall. In a
shaken voice Carey told reporters,""Edwin took the life from my son,
and that's the truth."
The Prosecution rested its case
Friday. The court will be closed on Monday for Columbus Day. The
defense will begin its case on Tuesday when Edwin Tirado is expected
to take the stand.
