Only requires telephone notification to parents when there is a “serious reportable incident.” 

Requires telephone notification to parents of any reportable incident within 24 hours of the incident. 

 

 

Parents can opt out of receiving a call when their child is injured.  No one should be given the opportunity to “opt out” of being a parent and receiving information on their children’s health and well being.  If parents choose to not act as a result of the phone call, that is their option.

Ensures that all incidents are reported to parents.

 

 

Parents are not entitled to a copy of incident reports.  In many cases, parents only receive a synopsis.

 

Parent receives a copy of the written incident report upon request (names of individuals involved are not included)

 

 

It is unclear what parents are entitled to. In current practice, parents receive limited or no information.

Parents, upon written request, are entitled to a copy of investigative reports about patient abuse or mistreatment.  Names of individuals involved are not included.

 

 

No pamphlet is provided to parents explaining their right to records access and appeals procedures

Commission on Quality Care and Advocacy for Persons with Disabilities is required to develop and distribute a pamphlet regarding the rights of parents to receive records and the process to appeal the denial of such request.

 

 

Only state-operated facilities are subject to incident reporting

 

Incident reporting requirements now include all licensed and certified facilities providing services to persons with mental disabilities.

 

 

No review of provisions or identification of records for improved access

Task Force is created to identify records, review provisions and seek means to improve practices

 

 

OMH providers are subject to penalty up to $1,000 per day or a max of $15,000 per violation.  OMRDD penalties are limited to $1,000.

 

Commissioner of OMRDD can impose a fine of $1,000 per day or maximum of $15,000 per violation on an OMRDD facility that is not in compliance, which equalizes OMRDD and OMH facilities.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 


A message about the Jonathan Carey Foundation

I, the parents of Jonathan, would first like to thank everyone for your love, your prayers, and your encouragement throughout this extremely difficult time, and for all your support as we were fighting for Jonathan’s Law. Our hearts are broken and the pain of missing Jonathan is excruciating at times, but we know that Jonathan is happy and safe with Jesus in Heaven for all eternity, which helps us tremendously.

Right now we must move forward. We are compelled to help other vulnerable children, and to help prevent other children from suffering abuse and neglect like Jonathan suffered. Most vulnerable children cannot speak or defend themselves and desperately need our help, meaning each and every one of us, in whatever way we can. Lisa and I have gained much insight through all that we have gone through, and have a responsibility to use that insight and knowledge to help bring about necessary changes. Our hope and our prayer is that these changes will affect the lives of thousands of precious children and their families. We must continue to raise awareness of the issues facing those living in residential care facilities and schools, and their families. We are also compelled to raise awareness and to encourage people to get involved in rescuing orphaned and abandoned children.

We are closing down our family business named Solo Auto Sales, located at 90 Delaware Avenue in Delmar, New York, and will be converting the use of the property into the office for The Jonathan Carey Foundation. We are now currently able to accept charitable contributions, which are tax deductible.
